California Gun Owners & Ammo Dealers Fire Back Against Proposition 63
Judge Roger T. Benitez, rules that Californians may again purchase ammo without a background check and order ammo online.
The experiment has been tried and the casualties have been counted - California’s new ammunition background check law misfires and the Second Amendment rights of California citizens have been gravely injured.

California’s citizens have struck a blow to Proposition 63 and its violation of their constitutional right to keep and bear arms. Today, Judge Roger T. Benitez has ruled that the Attorney General of California, Xavier Becerra, is enjoined from implementing or enforcing the ammunition sales background check provisions found in California Penal Code §§ 30370(a) through (d) and 30352, and the ammunition anti-importation provisions found in §§ 30312(a) and (b), and 30314(a) as well as the criminal enforcement of California Penal Code §§ 30365, 30312(d) and 30314(c).
What that means is that Californians are no longer subject to background checks that had an erroneous 16.4% denial rate in order to purchase ammunition.
Perhaps more importantly, face to face transactions are no longer required so Californains can again purchase ammo online for delivery directly to their houses.
Online shopping and delivery has perhaps never before been so important and not Californians don’t have to choose between staying healthy and staying safe.
While this is a big win for gun owners and sellers alike, the fight isn’t over. From here, Xavier Becerra will likely petition the Ninth Circuit Court to stay this injunction which would allow the State to again restrict the Second Amendment rights of their citizens.
Should California fail to obtain this stay, Kim Rhode, Ammunition Depot, and others will have to continue to fight to have these laws overturned.

PROPOSITION 63
Enacted in 2016, Proposition 63 placed sizable restrictions on Californian’s ability to purchase ammunition, by requiring that all ammunition sales and transfers be conducted via face-to-face transactions at California licensed firearm dealers or licensed ammunition vendors.
As of July 2019, all Californians looking to purchase ammo are required to pass a background check before picking up any delivery of ammunition.
